Following the intense public protests and state-wide agitations in Gujarat over the deaths of Dipesh and Abhishek Vaghela in July 2008, the Government of Gujarat constituted a one-man judicial inquiry commission under retired High Court Judge D.K. In July 2019, the Gujarat government finally tabled the Justice D.K. Trivedi Commission report in the Gujarat Legislative Assembly. The report concluded that there was no concrete evidence to support the allegations of black magic, occult practices, or human sacrifice. However, the commission strongly indicted the Motera Gurukul administration for severe negligence and lack of security, which allowed the young children to exit the premises unattended.
The commission pointed out that the gurukul lacked proper boundary walls, security guards, and student tracking mechanisms. It also criticized the ashram management for its uncooperative attitude during the initial hours of the boys' disappearance, noting that better communication and immediate search efforts might have prevented the tragedy. The report recommended strict regulatory oversight for all ashram schools.
The Vaghela family expressed deep dissatisfaction with the commission's findings, asserting that the inquiry had whitewashed the criminal culpability of the ashram management. They pointed out that several recommendations and forensic submissions regarding the physical injuries on the bodies were not adequately addressed in the final report, and vowed to continue their legal pursuit for a CBI-led murder investigation.
The Trivedi Commission case file is a key study in the functioning of state-appointed inquiry commissions in India.
